Terms and Conditions

Introduction

These terms and conditions are for mygameworx website use only and not our store. We may not have stock in store and prices may be different. By using our website, you accept these terms and conditions in full. If you disagree with any part of these terms and conditions, do not use our website. However the terms for repairs do apply to our store. 


My Game Worx repair agreement

No Fix  No Fee Console Repair

The amount of time taken to repair specified faults is only an estimate. This time is not guaranteed and is dependant on the availability of parts and/or current workload.
All our repair work is guaranteed for 28 days providing the My Game Worx warranty seal is not tampered with or removed.
My Game Worx reserves the right to withhold your console until payment is received. If after three months payment has not been received we are authorised to dispose of your console or use it as we see fit. In rare cases while we are trying to investigate or repair the cause of a consoles problem, symptoms my worsten. We are in no way liable for this. When a console such as an xbox 360 has been repaired for a ring problem like three red lights but then comes up with two lights or one you are not under warranty as these as different errors. Please note that when a console is sent or brought to our store we will only repair the fault you have requested, however we may call you to advise you about another fault. If your console has been reflowed on xbox 360 or ps3 this has nothing to do with laser or drive problems as they are separate parts of the console and the faults are not connected.If your manufacturers seal on yor console is broken your warrenty with the manufacturers is void. We are not liabe as it is your decision to have the console repaid and may need to break the seal.

 Please note that in rare cases if you have sent your console or used our collection service and it has been repaired but breaks down during the 28 days with the same error you the customer will be responsible for the postage however if it is different error you are not covered.

 Please note  before or during the course of repair, it may be necessary to clear data stored on your console's memory. We are sorry but as stated this is only done if necessary. Please ensure that your data is backed up prior to sending or bringing in your console in to us as we cannot guarantee that your data will be retained.

 

REPAIR QUOTES

My game worx repair quotes cannot be guarateed until your system has been tested but you will be informed if there is any price difference.   
REPAIR POSTAGE/ACCESSORIES POSTAGE

WE ONLY POST TO MAIN LAND UK. REPAIR POSTAGE A £10 charge for ps3, xbox 360, wii and £7 for ds/ds lite and psp.  
Warranty repairs only cover parts that have been replaced or repaired. This means we will not repair faults under warranty that have been caused by physical damage or negligence on the part of the user. My Game Worx reserves the right to determine the cause of the fault.
In some instances repairing your console means your serial number will change. In rare cases some consoles cannot be repaired we do not charge you for are time but you will have to pay for return of your console. My Game Worx reserves the right to replace your console with a second hand unit of the same condition.Please note that in rare cases if you have sent your console or used our collection service and it has been repaired but breaks down during the 28 days with the same error you the customer will be responsible for the postage however if it is different error you are not covered.  We are not responsble for any lose of saved data/memory. You are responsible for backup of your data.
Packages lost in post during delivery to My Game Worx are not the responsibility of My Game Worx. We recommend using an insured service that can be tracked so proof of postage can be obtained.


Intellectual property rights
Unless otherwise stated, we or our licensors own the intellectual property rights in the website and material on the website. Subject to the licence below, all these intellectual property rights are reserved.


Limitations of liability
The information on this website only provided free-of-charge, and you acknowledge that it would be unreasonable to hold us liable in anyway so please respect of this website and the information on it .
Whilst we try to ensure that the information on this website is correct, mygameworx do not warrant its completeness or accuracy; nor do we commit or hope  to ensuring that the website remains available or that the material on the website is kept up-to-date.
To the maximum extent permitted by applicable law we exclude all representations, warranties and conditions (including, without limitation, the conditions implied by law of satisfactory quality, fitness for purpose and the use of reasonable care and skill).
Our liability is limited and excluded to the maximum extent permitted under applicable law. We will not be liable for any direct or indirect loss or damage arising under these terms and conditions or in connection with our website, whether arising in tort, contract, or otherwise. Without limiting the generality of the foregoing exclusion, we will not be liable for any loss of profit, contracts, business, goodwill, data, income, revenue or anticipated savings arising under terms and conditions or in connection with our website, whether direct or indirect, and whether arising in tort, contract, or otherwise.
However, nothing in these terms and conditions shall exclude or limit our liability for fraud, for death or personal injury caused by our negligence, or for any other liability which cannot be excluded or limited under applicable law.


Restricted access
If we provide you with a user account to enable you to  areas of our website or other content or services, you must ensure that that user account details are kept confidential. You accept responsibility for all activities that occur under your user account.
We may disable your user account at our sole discretion if you breach any of the policies or terms governing your use of our website or any other contractual obligation you owe to us.

Forum / chat room
You must not use our website in any way that causes, or may cause, damage to the website or impairment of the availability or accessibility of the website.
You must not use our website in any way which is unlawful, illegal, fraudulent or harmful, or in connection with any unlawful, illegal, fraudulent or harmful purpose or activity.
You must not use our website for any purposes related to marketing without our express written consent.

We may take such action as we deem appropriate to deal with the posting of unsuitable material, including suspending or cancelling your account, restricting your access to our website, or commencing legal proceedings against you.

Returns/Guarantees Policy
How do I return an item?

explaining the reason for return, and we will advise you on what to do next.

To give you a few pointers on how we manage our returns, here are some simple and easy to follow guidelines

Faulty or defective items: If you return an item because of an error on our part, or it is defective, we will happily refund the cost of the item and any postage and packing. The item(s) must be returned within 15 days of purchase. This does not include damage caused by improper use and removal. Always read and make certain all users of the product read the instructions before use.

Change of heart: Goods returned to us because of a change of heart must be unused and in perfect, re-saleable condition (including product packaging, instructions, etc), otherwise we will not be able to refund you. The item(s) must be returned within 15 days of purchase.

Items lost in transit: We cannot be held responsible for packages lost in transit: as you are responsible for returning the item(s) to us, we recommend sending the package by Recorded/Special Delivery.

Refunds, replacement and exchanges: 
Refunds for items that are defective or faulty and sent back to mygameworx within 15 days or are the result of a change of heart and are sent back to mygameworx within 15 days, will be processed with a refund, return or exchange within 7 working days of receipt of the returned item(s) by mygameworx.  A refund will be made in the same form of payment that was used to make the initial purchase.

Please note that item(s) returned to us that are not due to our error will have the return shipping costs deducted from the refund.

Please also note, in all instances mygameworx shall not be liable for incidental or consequential damages or expenses, including but not limited to lost profits or other economic or commercial losses. This warranty does not affect your statutory rights.

Delivery

We only post to UK Mainland however you can call or email to arrange postage outsite Mainland UK
For stock items we aim to dispatch your order the next working day after we receive it. If in stock please allow 7 days for the order to arrive. We will let you know if there will be a delay, offering either to keep your goods on order or refund to you.

Please note:
For Rest of World, local import duties may be payable upon receipt. International delivery times vary depending on destination.


We use 3rd party courier coampanies , to act on your behalf, and once goods leave our premise, they are effectively no longer under our control and as such, no longer our responsibility. In the U.K, courier companies have a 99% sucess rate of delivering on time and to the correct address, meaning that 1 in 100 deliveries may fail. MYGAMEWORX  can not be held responsible in any way for failed, lost or damaged items. 

Packages lost in post during delivery to Revolver console are not the responsibility of  MYGAMEWORX. We recommend using an insured service that can be tracked so proof of postage can be obtained.
 

Complaints Procedure
MyGameWorx takes its relationships with customers very seriously, and we expend a great deal of effort ensuring that we keep you happy. We aim to reply to emails within one working day of receipt, whether they're enquiries or complaints. If e-mail is too impersonal, we encourage you to phone us on 01384 918 399, where our customer support team will gladly be of assistance. All your feedback is appreciated, although we prefer good news!

Stock Availability
We cannot always ensure permanent availability of all items, although we try our hardest. If something is out of stock we will do our very best to get it to you as soon as we can or if the delivery time is too long, we will let you know and you will have the choice as to what to do with your order.
